Building that special dream house is an increasingly popular option for both established residents and newcomers. When considering land purchases and home building, keep in mind these handy tips:

• When purchasing land, try to acquire title by Warranty Deed.
• Request a Certificate of Survey for small acreages.
• What are the septic system requirements? Note that septic permits are required statewide.
• Is water available in the area?
• What zoning and planning permits are required?
• What covenants or restrictions exist on the property?
• Are there any area hunting and fishing regulations?
• Is electricity available? If not, are there alternative energy suppliers (solar, wind, hydro, propane gas, internal combustion generators) in the area?
• Be aware that the state does require an electrical inspection before hooking up new services to a power company.
• Contact the Department of Natural Resources and Conservation for questions about soil, plants, and waterways.

Another important item to consider when purchasing property is a conservation easement. This legal contract between you and the easement holder is attached to your deed and documents what activities are allowed and prohibited on your property. The easement remains forever attached to the property, and the easement holder is responsible for upholding the regulations. By signing a conservation easement, you are ensuring that Montana’s wide-open spaces and wildlife habitats will be preserved for the future.
